Rule 13.1: Persons not allowed to act as Trustees
Members of the Group, District and County Executive Committees are the 'charity trustees' of the Group, District or County.
No person who is disqualified from being a charity trustee by virtue of the Charities Act may be a member of a Group, District or County Executive Committee
The appointment of any such person, whether as Ex officio, by nomination, by election or by co-option shall be void.
It is the responsibility of each person to ensure that he is not disqualified before accepting an appointment as a trustee.
The Charities Acts apply to England and Wales only. Similar legislation applies to Scotland.
Certain people are disqualified from continuing as a trustee, or from becoming a trustee. They are people who:
have been convicted at any time of any offence involving deception or dishonesty, unless the conviction is regarded as spent; or
are undischarged bankrupts; or
have made compositions with their creditors under the Insolvency Act 1986 which have not been discharged; or
have at any time been removed by the Charity Commissioners or by the court in England, Wales or Scotland from being a trustee because of misconduct; or
are disqualified from being company directors; or
have failed to make payments under county court administration orders.
